This Privacy Policy details what personal information Vybe, LLC (“Vybe”) collects on Vybe websites, applications and platforms to provide Vybe products and Services ("Services"). Please read this Privacy Policy carefully. By using Vybe you consent to these policies.  

Privacy Philosophy

Vybe values your privacy highly. We strive to only collect the minimal data necessary to provide Services to you. Vybe does not get, keep, have or want the private keys to any user’s cryptocurrency wallet. These keys are retained by users. Vybe does not need them to provide our Services. Given this, Vybe cannot identify owners of cryptocurrency wallets unless that user has agreed to provided identifying information. Vybe can’t access users’ wallets, nor recall or cancel Vybe transactions, which occur independently on the Algorand blockchain and, as such, are subject to the technical parameters of that decentralized technology.

Changes and Updates to the Privacy Policy

Our Services may change and we may update this Privacy Policy. We reserve the right to amend this policy at any time and will provide notice of material changes on this website. By continuing to use the Services after changes to the Privacy Policy have become effective, you agree to all revised policies.

Account Registration

You have to create a Vybe account to use some Vybe Services. To do so, you may have to provide personal information. You are responsible for all activity that occurs under your account, including any actions taken by persons to whom you have granted access to your account. We reserve the right to suspend or terminate your account at any time.

What Information Do We Collect?

We collect personal information about you to provide Services. You automatically consent to provide this information when you use a Vybe product or Service. Information we may collect includes:

- Identification and Contact Information. This may include your name, position, company, telephone number and email address that you give us to create an account or use a Service. We will use this data to provide Services and communicate with you.

 

- Device Information. Information about your device, including its location, your hardware model, operating system and version, device name, unique device identifier, mobile network information, and information about the device’s interaction with our Services.

 

- Use Information. Information about how you use our Services, including your access time, “log-in” and “log-out” information, browser type and language, country and language setting on your device, Internet Protocol (“IP”) address, the domain name of your Internet service provider, other attributes about your browser, mobile device and operating system, any specific page you visit on our platform, content you view, features you use, the date and time of your visit to or use of the Services, your search terms, the website you visited before you visited or used the Services, data about how you interact with our Services, and other clickstream data.

- Identity Verification. Information from third-party verification services, credit bureaus, financial institutions, mailing list providers, and publicly available sources.

 

- Credit, Compliance and Fraud. Information about you from third parties in connection with any credit investigation, credit eligibility, identity or account verification process, fraud detection process, or collection procedure, or as may otherwise be required by applicable law. This includes, without limitation, the receipt and exchange of account or credit-related information with any credit reporting agency or credit bureau, where lawful, and any person or corporation with whom you have had, currently have, or may have a financial relationship, including without limitation past, present, and future places of employment, financial institutions, and personal reporting agencies.

- Third Parties. We may collect information about you from other sources if needed to improve our Services, including publicly available databases, the internet, trusted third-party Services, or partners.

How We Use Your Information?

We may use your information to:

- Improve and develop our Services;

- Determine whether the Services are available in your country;

- Develop new products and services;

- Deliver information and support you request, including technical notices, security alerts, and support and administrative messages including to resolve disputes;

- Collect fees and provide technical support;

- Improve, personalize and facilitate your use of our Services;

- Measure, track, and analyze trends and usage in connection with your use or the performance of our Services.

- Send you information we think you may find useful or which you have requested from us about our products and services;

- Conduct surveys and collect feedback about our Services;

- Protect our Services and maintain a trusted environment;

- Investigate, detect, prevent, or report fraud, misrepresentations, security breaches or incidents, other potentially prohibited or illegal activities, or to otherwise help protect your account;

- Protect our users’ rights or property, or the security or integrity of our Services;

- Enforce our Terms pf Service or other applicable agreements or policies;

- Verify your identity; and to

- Comply with any applicable laws or regulations, or in response to lawful requests for information from the government or through legal process.

Logging in with Google

When you create a Vybe account or login with Google, which Google calls OAuth registration, Vybe can see and registers your Google email and profile. As such, Vybe can see and registers your primary Google Account email address and your profile, including any personal info you've made publicly available. Vybe saves your email and profile data in a database to verify you and populate your Vybe profile. These are "non-sensitive" scopes. Vybe can not see and does not collect or store any "sensitive scopes" from your Google account. Vybe does not do anything else with this information. Vybe does not, specifically, share or sell your Google email or profile data in any way. 

Your Content

You grant Vybe and our subsidiaries, affiliates, and successors a worldwide, non-exclusive, royalty-free, fully-paid, transferable, and sub-licensable right to use, reproduce, modify, adapt, publish, prepare derivative works of, distribute, publicly perform, and publicly display any Content you upload to a Vybe site throughout the world in any media form. You may modify or remove your Content via your Vybe Account or by terminating your Vybe Account, but your Content may persist in historical, archived or cached copies and versions thereof available on or through the Services.

 

You will not upload or provide Content or otherwise post, transmit, distribute, or disseminate through the Services any material that: (a) is false, misleading, unlawful, obscene, indecent, lewd, pornographic, defamatory, libelous, threatening, harassing, hateful, abusive, or inflammatory; (b) encourages conduct that would be considered a criminal offense or gives rise to civil liability; (c) breaches any duty toward or rights of any person or entity, including rights of publicity, privacy or trademark; (d) contains corrupted data or any other harmful, disruptive, or destructive files; (e) advertises products or Services competitive with Vybe or our partners’ products and Services, as determined by us in our sole discretion; or (f) in our sole judgment, is objectionable, restricts or inhibits any person or entity from using or enjoying any portion of the Services, or which may expose Vybe, its affiliates or its customers to harm or liability of any nature.

 

Although we have no obligation to monitor any Content, we have absolute discretion to remove Content at any time and for any reason without notice. You understand that by using the Services, you may be exposed to Content that is offensive, indecent, or objectionable. We take no responsibility and assume no liability for any Content, including any loss or damage to any of your Content.

 

Cookies

Our websites use cookies to provide enhanced functionality. A cookie is a text file placed on your computer to help the website analyze how you use the site. When you visit the site again, the cookie enables the site to recognize your browser and deliver an improved user experience. This saves time and creates a customized experience.

We use first-party cookies (set by Vybe) and third-party cookies (set by other parties) that enable features such as advertising, interactive content and analytics to be provided. We use, specifically, Essential Website, Performance, Functionality, Analytics, Customization, Advertising and Social Networking cookies, which enable you to share pages and content that you find interesting on our websites and apps.

The information generated by the cookie about your use of the website, including your IP address, may be transmitted to and stored by our domain host on servers. The domain host may use this information to evaluate your use of the website, compiling reports on website activity for website operators and providing other Services relating to website activity and internet usage. The domain host may also transfer this information to third parties where required to do so by law, or where such third parties process the information on the domain host’s behalf.

Pixel tags

We may use pixel tags, which are also known as web beacons and clear GIFs, on our website to track user actions. Unlike cookies, which are stored on the hard drive of your computer or mobile device by a website, pixel tags are embedded invisibly on webpages. Pixel tags measure the success of our marketing campaigns and compile statistics about usage of the site, so that we can manage our content more effectively. The information we collect using pixel tags is not linked to our users’ personal information.

 

How Long do We Retain Your Information?

Third Party Websites

Vybe is not responsible for the content or privacy practices of non-Vybe websites to which the websites may link. You can review the privacy Notice of such websites before using the sites.

Vendor Partners

We may run a joint or co-sponsored program or promotion via our online tools with another company, organization or reputable third party. As part of this event, we may collect and process personal information. When doing any promotional or marketing activity with another company, we will give you the opportunity to opt in to receive information directly from that third-party company.

Service Providers

We may use third parties to provide service support for the internal operations of our websites, applications and online advertisements, and to assist us in the administration of our websites, applications, advertisements, and functions, programs and promotions we run. These third parties may encounter your personal information as a result of providing Services to us. We may also disclose your personal information to any third party with your prior consent.

The legal basis for the processing of your Personal Information as described above is your consent or our need for processing your personal information in order to be able to perform a Service. In some cases, we may also have a legal obligation to collect personal information from you and process it. When you submit Personal Information through our website or other means, you understand and agree that this information may be transferred across state and international boundaries and may be stored and processed by Vybe and its affiliates in any of the states in which Vybe has offices or data center space. We put in place appropriate contractual data protection agreements or use other appropriate legal mechanisms to safeguard the transfer of information. You also acknowledge that in certain countries or with respect to certain activities, the collection, transferring, storage and processing of your information may be undertaken by technology vendor partners.

Security of your Personal Information

Vybe and its affiliates have put in place appropriate physical, technical measures and managerial procedures to safeguard and help prevent your personal information from loss, misuse, unauthorized access, disclosure, alteration or destruction. We update and test such security measures on an ongoing basis and restrict access to your personal information to those employees who need to know that information to provide Services to you. However, we cannot guarantee that unauthorized third parties will never be able to defeat those measures or use your personal information for improper purposes. You provide your personal information at your own risk. If a password is used to protect your account with us, it is your responsibility to keep the password confidential. Do not share this information with anyone.

Access and Control over your Personal Information

You may access, change, or correct information that you have provided by logging into your account at any time or by making a request to us. We may need to verify your identity before granting access or otherwise changing or correcting your information.

 

Governing Law

 

This Privacy Policy and any dispute will be governed by Wyoming, USA law and/or applicable Arbitration Act as applied to agreements entered into and to be performed entirely within Wyoming, USA, without regard to its choice of law or conflicts of law principles.
